Congress and the Family Smoking Prevention and Tobacco Control Act...

The 111th Congress of the United States' acceptance of the "Family Smoking Prevention and Tobacco Control Act" represents a blow to the liberties of Americans and further erosion to the integrity of the Constitution of the United States. The act gives massive new powers to the FDA in all things tobacco related. Under the new law all businesses involved in the production, processing, packaging and distribution of tobacco must register with the FDA and comply with unwarranted FDA inspections. Congress making such a law violates the Fourth Amendment of the Constitution of the United States which states "the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." The act goes even further to dictate where, when, and how tobacco can be advertised, a violation of the First Amendment of the Constitution of the United States "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."

The Family Smoking Prevention and Tobacco Control Act agreeably has good motives, though it is often the case that personal liberties are lost due to the best intentions. Listening to the 111th Congress one can't help but get the idea that the majority in Capital Hill views tobacco as "morally wrong." Let us remind our congressmen and women of the wise words found In Notes on Virginia (1782), by Thomas Jefferson. "The rights of conscience we never submitted, we could not submit. We are answerable for them to our god. The legitimate powers of government extend to such acts as are injurious to others. But it does me no injury for my neighbor to say there are twenty gods, or no god. It neither picks my pocket nor breaks my leg."

Smoking is a bad habit, nothing more and nothing less; the dangers of secondhand smoking are known and avoidable; furthermore, smoking itself is an unalienable personal choice. The 111th Congress has no right under the Constitution to make such laws as found within the pages of the Family Smoking Prevention and Tobacco Control Act to further regulate, and tax one of our nation's few remaining domestic industries. Tell Congress to end their unconstitutional war on tobacco and worry more about finding a way out of their unconstitutional wars in the Middle East.

Rand Paul Money Bomb.

On March 23, 2010 the anniversary of Patrick Henry's famous "give me liberty or give me death" U.S. Senate hopeful Rand Paul R-KY raised $261,880 in a 24 hour online fundraising "Give Me Liberty” Money Bomb. Rand Paul ( son of Texas congressman Ron Paul) has raised $550,000 this quarter and is up to $2,335,858.00 in total raised funds. On a side note, his republican opponent has been recently endorsed by Dick Cheney, another reason to predict a Rand victory.
